IMPORTANT NOTICE TO OUR MEMBERS:
Please be advised that recently we have seen an increase in the
number of members who have been contacted by someone claiming that
they have a buyer for the member’s week(s) in the Club. These “cold
calls” all have one thing in common; they claim to have a buyer NOW
and that the member needs to send an amount, usually between 900 and
2,000 Euros for the legal paperwork to affect this sale.
Please be aware that any cold call offering anything similar is
undoubtedly a scam. DO NOT FALL FOR THEIR PROMISES.
We have also been made aware that some of these callers are now
professing to work for “Pueblo Evita Finance” and that their monies
would be held secure by this company, which they claim, is attached
to our Clubs. PLEASE NOTE THAT NEITHER PUEBLO EVITA CLUB NOR
FAIRWAYS CLUB HAVE ANY DEALINGS WHATSOEVER WITH THIS COMPANY THAT
CALL THEMSELVES PUEBLO EVITA FINANCE.
Suffice it to say, that if you receive a direct marketing call
to your home or work, suggesting that they have a client that is
waiting to buy your week in the club, then there is every chance
that this is part of a scam. Please do not send any money to anyone
calling you and saying that they have a buyer for your timeshare,
nor should you send them your signed deeds UNDER ANY CIRCUMSTANCES.
If and when you do want to sell your week(s) the owner always needs
to sign the back of the Holiday Certificates, enter the details of
the new owner and send to the trustees, FNTC in the Isle of Man. Do
not ever hand these deeds over to a third party to do this for you.
If you have been caught up in one of these
so-called “offers”, we suggest that you get in touch with
the Timeshare Consumer Association’s Helpline (TATOC) which
have been VERY successful in getting UK members money back,
when they have paid with their credit card, even if this was

FLOATING TIME
Following the recent AGM, members
approved a modification in the Constitution of the Club with respect
to the usage of weeks in the Club. From 1 January, 2009, all
apartments in the Club are now on a Floating time basis. This means
that for all units (studios, 1-beds, 2- beds and 3-beds), both
Standards and Elites, are now allocated to all members from the Main
Management office in Malaga. Those members that in the past had
fixed weeks will now need to contact the allocations department to
request the week(s) they want to use at the Club or for banking
purposes.

The R.D.O. (Resort
Development Organisation)
is a trade body that most successful timeshare operators in Europe
belong to. They have a code of ethics for all their members,
including any Timeshare Resale companies.
Their Code of Ethics states:
R.D.O. MEMBERS RESALE CODE
Resale R.D.O. Members should clearly disclose to seller and buyer, as
appropriate, the relevant obligations and rights of all parties to
the resale marketing, sales and conveyance transactions, including
but not limited to the Resale Member and the seller and buyer of the
timeshare interest.
Resale members must offer buyers of resale timeshare interests the
same benefits of cooling-off period and protection of advance
payments as are offered to other buyers of timeshare interests or as
otherwise provided by the Law.
Resale Members may not directly nor through a third party make
unsolicited contact, via telephone, fax or mail, with timeshare
owners on what is, or may be construed to be, a cold call approach
aimed at inducing such owners to permit the resale organisation to
act as their selling agent.
Resale Members may not directly or indirectly solicit a fee from a
vendor by falsely representing that there is a purchaser ready,
willing and able to acquire the vendor's timeshare.
Resale Members are not permitted to take any form of mandatory
upfront payments for the listing, marketing and sale of any
timeshare interest.
